Our business relationship is based on a Letter of Authorization by which your company engages DPS Specialty as your insurance broker for all insurance matters or for a specific project.

The broker’s engagement is legally regulated through this authorization and does not create any additional financial obligation for you. It can be terminated in writing at any time. By appointing a broker, you are further protected through our professional liability insurance policy.

In accordance with EU standards, the insured amount under our professional liability insurance is EUR 1,564,610 per claim and EUR 2,315,610 for all claims within one year.

Case Study

Concert

We insured an electronic music concert in a nightclub that was cancelled five days before the scheduled date because the club received an official administrative fine from the authorities one week prior to the event, which prohibited it from operating for the next 14 days due to non-compliance with the local smoking law.

The key element in this case was the fact that the organizer was not aware, nor could have been aware, that such a ban was pending for the club, which made this situation an insurable event. We compensated the organizer for all non-recoverable expenses incurred, including all event organization costs (marketing included), the agreed fee for the performer (which was also covered by the insurance), and the expected profit of the organizer.

Profit payout in practice depends on the percentage of tickets actually sold. If the event was sold out at the time of cancellation, the full expected profit is compensated. If 50% of tickets were sold, the profit is paid proportionally.

Injury

At a concert held in the Gripe hall in Split, a female attendee fell and suffered an open fracture of her lower leg. Even after two years, she had not fully recovered. She and her attorney contacted the organizer and filed a claim for compensation for the injury suffered. The policy included third-party liability coverage, and under our law, the organizer is always legally liable in such cases if charging admission to the event. The default limit for such claims in our policies is EUR 1,250,000, and we were able to cover the claim without difficulty.

Concert Cancellation

An open-air concert was cancelled due to a safety threat caused by a large wildfire that broke out near the concert venue and which firefighters were unable to bring under control. The cancellation was officially imposed by local authorities due to the clear danger posed to attendees and performers. The organizer was compensated for all non-recoverable expenses, the performer’s fee, and the expected profit from organizing the event.

  • Inclement weather cover

    This insurance covers all non-recoverable costs that may arise due to the postponement or cancellation of the event caused by an official ban on holding the event due to one or more weather-related factors that endanger the safety of performers and attendees, and that occur at the planned event location.

    This is by far the greatest risk for organizers of outdoor events. Of all the claim payouts for insured events, 52% are due to inclement weather.

     

    • Inclement weather conditions covered by this insurance include:
    • Wind blowing at a minimum speed of 69 km/h
    • Heavy rainfall, with minimum intensity as follows:
    • 8 mm of accumulated rain in the hour preceding the scheduled start of the event
    • 12 mm of accumulated rain in the two hours preceding the scheduled start
    • 35 mm of accumulated rain in the 24 hours preceding the scheduled start of the event
    • Violent storm
    • Settling of the ground and mudslide following inclement weather
    • Weight of the snow weakening any fixed or mobile frame
    • Overflowing of watercourse
    • Torrential rain
    • Natural disasters
    • Flooding of more than 30% of the ground where the event is taking place

     

    Upon submission of supporting documentation, this insurance covers compensation for non-recoverable costs incurred due to the need to complete the organization and execution of the event.

    We also insure the organizer’s projected profit, provided it is included in the insured sum and the event is indeed canceled.

    In the event of a claim, the production must obtain a written ban from local authorities stating that the execution of the event is compromised for safety reasons. The production must also provide an official weather report from the nearest official meteorological station to prove that one of the insured conditions for payout has occurred. Additionally, photographs or video footage of the weather event and resulting damage must be taken and submitted immediately.

  • Event cancellation

    We cover all financial consequences that the producer suffers due to the cancellation, interruption, or postponement of the event for any reason beyond the producer’s control, provided that the circumstances leading to the cancellation were not known to the producer at the time the policy was taken out.

    This is the second greatest risk for producers. Of all claim payouts for insured events, 22% of the funds are paid out due to cancellation risk.

    Insured risks:

    • Any official government ban preventing the planned event from taking place, but only if a written permit for the event had been previously issued.
    • Inclement weather conditions, but only for productions planned entirely indoors. For outdoor productions, inclement weather insurance applies.
    • Cyclone, hurricane, tornado, earthquake, volcanic eruption, tsunami, or landslide.
    • A terrorist act at or near the event location, resulting in local authorities declaring that the event cannot be held or access to the venue is not possible.
    • A day of mourning declared by local authorities that, by its nature, imposes a prohibition or leads to the cancellation of the event. 
  • Non-appearance

     Non-appearance of key performers (Non-appearance) – we cover all financial losses suffered by the production due to the postponement, interruption, or cancellation of the event caused by the death, accidental injury, illness, or arrest of the insured person. Of all claims paid on insured events, 17.83% of the funds are paid due to non-appearance risk

    The subject of insurance includes non-recoverable production costs, expected profit of the organizer, performers’ fees if specifically agreed, sponsorships, donations, financial partnerships provided they indeed must be returned if the event is cancelled

    • The insurance also covers the closest relatives of the insured person – parents, children, fiancée/fiancé or wife/husband, if their illness or injury resulted in hospitalization lasting at least 5 days
    • If we are insuring a project with a budget exceeding EUR 1 million, and if the person insured under the non-appearance risk is over 75 years of age, a medical examination is mandatory for individuals meeting one or both criteria. The cost of the medical examination is borne by the insurer
    • Coverage under this section of the all-risk policy will not and cannot be activated before submission of the names of the insured persons.
  • Additional costs insurance (Additional costs)

    Claims under the risks of cancellation, non-appearance, and inclement weather usually result in additional financial expenses. 

    Approximately 2.5% of all claim payouts on insured projects relate to these costs

    • Under this risk, we insure the financial consequences suffered by the producer as a result of the occurrence of the above-mentioned perils, or as expenses incurred to prevent the occurrence of said perils and the cancellation of the event
    • Also covered are any expenses the producer incurs in order to postpone the insured event and avoid its cancellation, provided the event ultimately takes place
    • Also covered are expenses resulting from damage, destruction, burglary, or robbery of equipment, sets, costumes, and other items the producer needs in order to avoid postponement or cancellation of the event
    • Unexplained disappearances of items are not covered
  • Third party (civil) liability

    Extra-contractual public liability borne by the producer for damage to third parties and their property arising during activities carried out in the execution of the insured event, for which the producer could be held legally liable; including people, buildings, and animals. Around 2% of all claim payouts on insured events relate to this type of damage. The insurance also covers:

     

    • Food poisoning
    • Delays in the delivery of goods and services necessary for the execution of the event
    • Liability arising from damages caused by subcontractors acting on behalf of the organizer
    • If the damage is caused by persons on whose behalf you are undertaking certain actions
    • Damage to vehicles parked in reserved spaces
    • Legal protection costs up to a maximum of EUR 50,000
    • We can offer a per-claim limit ranging from EUR 250,000 to EUR 7,500,000
    • We cover both material damage and bodily injury 

     

    Definition of third parties:

    • All individuals officially engaged and working on the event are NOT CONSIDERED THIRD PARTIES and are not covered by this insurance, but they can be insured under accident insurance.
    • VISITORS AND AUDIENCE MEMBERS ARE CONSIDERED THIRD PARTIES.
  • Entrusted property liability

    We insure damage to property for which the producer may be held liable and which is used in the execution of the insured event. This type of damage accounts for 0.6% of all claims paid on insured events.

          Insured risks:

    • Loss
    • Damage
    • Burglary and robbery
    • Destruction
    • Among other things, the insurance covers:
    • Damage caused by accidental incidents to premises for which you are responsible
    • Scenery, furniture, and other items belonging to third parties that are part of the overall equipment needed for the event

     

  • Third party property liability

    The insurance covers actual damage to properties you occupy during the policy period and for which the producer may be held legally liable. This type of damage accounts for 0.24% of all claims paid on insured events. 

     

    The following causes of damage are covered:

    • Fire
    • Damage caused by electrical current
    • Damage caused by water
    • Glass breakage
    • Explosion

     

  • Personal accident insurance

    This insurance provides a one-time compensation to insured individuals and/or their families in the event of an accident. Covered risks include death, permanent disability, temporary incapacity for work, and medical expenses resulting from the consequences of an accident. This insurance does not provide any compensation in the case of illness. The policy may include coverage for:

    • Audience
    • Performers
    • Staff working at the event

     

    Typical insured risks and default limits:

    • Accidental death – EUR 75,000
    • Permanent disability – EUR 150,000
    • Medical expenses resulting from the accident – EUR 25,000
    • Temporary incapacity for work – EUR 15,000 during 12 months after the injury
    • We can also insure animals participating in the event against the risk of death and cover veterinary costs up to the agreed limit.
